Terms of Use

The agreement between you and GamifyApps for using Video Compressor Audio & Photo, including how subscriptions and purchases work.

1. Agreement

These Terms of Use (“Terms”) are an agreement between you and GamifyApps (“we”, “us”) about your use of the Video Compressor Audio & Photo mobile application (the “App”) and this website. By downloading or using the App you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the App.

If you download the App from the Apple App Store, these Terms are the licence agreement for the App and take the place of Apple's standard licensed application end-user licence agreement, together with the additional terms in Section 10. Where these Terms do not address something, Apple's Licensed Application End User License Agreement applies.

2. Licence

We grant you a personal, non-exclusive, non-transferable, revocable licence to install and use the App on devices you own or control, for your personal or internal business use, as permitted by the usage rules of the store you obtained it from. You may not copy, modify, reverse-engineer, decompile or redistribute the App except where the law expressly allows it, or where an open-source licence for a component included in the App permits it. The App, its design and its name remain the property of GamifyApps and its licensors.

3. Your content

The videos, photos and audio you compress (“your content”) stay yours. The App processes them on your device and we do not receive, store or claim any rights in them.

Compression is lossy by nature: a smaller file usually contains less detail than the original. The App does not modify or delete your original files. Keep your originals until you have checked any result you care about; we are not responsible for loss of quality, or for originals you delete yourself.

4. Acceptable use

You agree to use the App lawfully. In particular, you must only process content you own or have the right to use, and you must not use the App to infringe anyone's copyright, privacy or other rights, or to create or distribute unlawful material. You must not interfere with the App's advertising or purchase systems, or attempt to unlock paid features without paying for them.

5. Free version and advertising

The App is free to download and use, with limits (such as a maximum file size and batch size) and with advertising provided by Google AdMob. Some features can be unlocked temporarily by choosing to watch a rewarded ad. We may change which features are free, limited or included in Pro, but we will not remove a feature you have already paid for during a period you have paid for. How advertising uses data is explained in the Privacy Policy.

6. Pro, subscriptions and purchases

Pro removes ads and the free version's limits, and unlocks all presets and formats. It is offered as:

  • Auto-renewing subscriptions — weekly, monthly or yearly; and
  • Lifetime — a single, one-time payment that does not renew.

The price, billing period and any free-trial length are shown in the App before you buy, in your local currency. Purchases are processed by the Apple App Store or Google Play using the payment method on your store account.

Automatic renewal

  • Payment is charged to your Apple ID or Google account when you confirm the purchase (or when a free trial ends).
  • A subscription renews automatically for the same period and price unless you cancel it at least 24 hours before the end of the current period. Your account is charged for renewal within the 24 hours before the current period ends.
  • If we change the price of a subscription, the store will notify you in advance and, where required, ask for your consent before the new price applies.

Free trials

Where a free trial is offered, it converts to a paid subscription when it ends unless you cancel at least 24 hours before it ends. On the App Store, any unused part of a free trial is forfeited when you buy a subscription. Trials are available once per account.

Managing and cancelling

Cancelling stops future renewals; you keep Pro until the end of the period you have already paid for. Deleting the App does not cancel a subscription.

Restoring purchases

Pro is linked to the Apple ID or Google account you bought it with. To use it on a new or reset device signed in to that account, open the App and tap Settings → Restore purchases.

7. Refunds

Because payments are processed by Apple or Google, refunds are handled by them under their policies. You can request one from Apple at reportaproblem.apple.com, or from Google Play through your order history or the Google Play refund page. Nothing in these Terms limits any refund or other rights you have under consumer law.

8. Disclaimer

To the extent permitted by law, the App is provided “as is” and “as available”. We work hard to make it reliable, but we do not promise that it will be error-free, uninterrupted, compatible with every file or device, or that a particular file can be compressed to a particular size or quality. Results depend on your device, its hardware encoders and the source file.

9. Limitation of liability

To the extent permitted by law, GamifyApps is not liable for indirect, incidental, special or consequential losses, or for loss of data, content or profits, arising from your use of the App. Our total liability for any claim relating to the App is limited to the amount you paid us for the App in the 12 months before the claim. Some jurisdictions do not allow these limitations, so they may not apply to you; nothing in these Terms excludes liability that cannot be excluded by law, including for death or personal injury caused by negligence, or for fraud.

10. Additional terms for the Apple App Store

If you obtained the App from the Apple App Store:

  • These Terms are between you and GamifyApps only, not Apple. GamifyApps, not Apple, is solely responsible for the App and its content.
  • Your licence is limited to use on Apple-branded products you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions.
  • Apple has no obligation to provide maintenance or support for the App. Support is provided by GamifyApps at the contact details below.
  • If the App fails to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price (if any) for the App; to the maximum extent permitted by law, Apple has no other warranty obligation for the App.
  • GamifyApps, not Apple, is responsible for addressing any claims by you or a third party relating to the App, including product-liability claims, claims that the App fails to meet legal or regulatory requirements, and claims under consumer-protection, privacy or similar laws.
  • If a third party claims that the App or your use of it infringes their intellectual property rights, GamifyApps, not Apple, is responsible for investigating, defending, settling and discharging that claim.
  • You confirm that you are not located in a country subject to a U.S. Government embargo or designated as a “terrorist supporting” country, and that you are not on any U.S. Government list of prohibited or restricted parties.
  • You must comply with any applicable third-party terms (such as your wireless data service agreement) when using the App.
  • Apple and its subsidiaries are third-party beneficiaries of these Terms and, once you accept them, Apple may enforce them against you as a third-party beneficiary.

11. Additional terms for Google Play

If you obtained the App from Google Play, your use is also subject to the Google Play Terms of Service. Google is not responsible for the App or for support relating to it.

12. General

  • Changes. We may update these Terms, for example when we add features. We will post the new version here with a new effective date and, for significant changes, tell you in the App. Continuing to use the App after a change means you accept it.
  • Ending. You can stop using the App at any time by deleting it (and cancelling any subscription in your store account). We may suspend your licence if you seriously breach these Terms.
  • Third-party components. The App includes open-source software, used under its own licences; those licences prevail for those components.
  • Governing law. These Terms are governed by the laws of the place where GamifyApps is established, without affecting any mandatory consumer protections of the country where you live, including your right to bring proceedings in your local courts.
  • Severability. If any part of these Terms is found unenforceable, the rest remains in effect.
